Some are out there saying in war there are no rules, and that Good Guys are out there doing whatever they have to, to win.
I'm of a different mindset, because seems to me this is all about restoring Law & Order and that would require following Military Regulation and the Laws of Armed Conflict, and there still has to be consideration of War Crimes as well as justification for Military Tribunals.
That said, the Laws of Warfare and the Powers of a Wartime President are many & have all kinds of options available to destroy an enemy within lawful bounds.
Under certain circumstances it would be 100% lawful, for example, for the Enemy to rounded up & destroyed by the Military or even PMCs without receiving a trial...for example when that 1 year deadline to identify is past & they become "undeclared belligerents" or spies. NO PROTECTIONS FOR SPIES. Besides, Flags Matter.
