When I taught in a low-income area, teachers had to attend a seminar. This seminar contained a several-step plan to follow to avoid calling CPS. As a mandated reporter, we could be held liable if we didn't call CPS. They were telling us to have counseling sessions with the parents. I can see why now, but they were asking the impossible.
Mandated Reporting Requirements
Legal Duty: In most jurisdictions, individuals designated as mandated reporters (such as counselors, teachers, social workers, and healthcare professionals) are legally required to immediately report any reasonable suspicion of child abuse or neglect to the relevant authorities, typically Child Protective Services (CPS) [1].
Liability for Failure to Report: Failure to report when there is a suspicion can result in civil liability, and sometimes criminal charges, for the reporter [1]. The law prioritizes the safety and well-being of the child above the parents' desire for confidentiality or ongoing counseling.
