As we explain below, the President's authority to detain enemy combatants, including U.S. citizens, is based on his constitutional authority as Commander in Chief.
In order to understand the scope of section 4001(a), we first set out the proper context established by the President's authority to detain enemy combatants during war.
That authority arises out of the President's constitutional status as Commander in Chief. Under the Commander in Chief Clause, the President is authorized to detain all enemy combatants, including U.S. citizens.
Finally, we note that Congress has specifically authorized the President to use force against enemy combatants in response to the terrorist attack of September 11.
