thank you for the link. so far Im seeing much of the criteria of crimes against humanity, genocide, etc satisfactory met within the definitions and in the procedures for the apprehension and pretrial processes are delineated. ...I have to fall back asleep for awhile before continuing. Is there a particular article/s that are the source of impediment to justice other than the failure of duty within the host state by current individuals in the international arena reverting to geopolitics vs criminality?

There are no covid case. There's a a group that has filed a report, just in the same manner you can report to the police that a crime has been committed.
Those guys might or they might not look into the matter and decide whether they think it's a valid crime, if there seems to be enough substance in the repport to support the claim that there is a crime committed. (just as an ordinary investigative law enforcement officer and or prosecutor would do).
If the Prosecutor decides, there are no crime to see here, there are no investigations done.
If the Prosecutor decides that there might be a crime committed, the Prosecutor has to present the case for the Pre-Trial Chamber and ask for permission to to proceed with an investigation.
If the Pre-Trial Chamber says "no-go", there are no investigations done.
