"dismiss a complaint when the Court lacks subject matter jurisdiction." Yes, it is under appeal. I believe the issue is the entertainment issue has been exposed from Weinstein, Epstein, Maxwell and others coming forward. With the aforementioned more individuals will be suing and using the depo's and cases as evidence.
