As CiC, he can set up a Military commission to try aliens and those who aid. Terrorists and those who aid and other belligerents.

The DC Circuit Court and DC Appeals Court as well as SCOTUS can review final decisions that come out of this Commission.

Hegseth would be the person to establish the Commission.
