Menendez was actually indicted in 2015. I remember hearing about it then and wondered how he was able to be in Biden administration.

Yeah.
Looks like he was acquitted on the 2015 charges.
Maybe it was 2-tier justice which got him off, but it is innocent until proven guilty.

or the secret deal which was the flip of Menendez to take a role in The Plan. Maybe he was secretly convicted and offered this role as a way to not be executed.
